1. Agreement to Terms

By accessing or using Mind Palace (the "App"), provided by Element.co ("we," "us," or "our"), you agree to be bound by these Terms of Use. If you do not agree to these terms, please do not use the App.

2. Use of the App

Mind Palace is a memory training tool that utilizes the Method of Loci and Spaced Repetition. You are responsible for maintaining the confidentiality of your account information and for all activities that occur under your account.

You agree not to:

  • Use the App for any illegal or unauthorized purpose.
  • Attempt to hack, destabilize, or adapt the App's source code.
  • Upload content that infringes on third-party intellectual property rights.
  • Upload, store, or generate any content that is offensive, abusive, illegal, or highly objectionable. We reserve the right to terminate accounts that violate this policy.

3. Subscriptions and Payments

Mind Palace offers various subscription tiers (Free, Starter, and Pro). By subscribing, you agree to the following:

  • Billing: Subscriptions are managed via the Apple App Store or Google Play Store. Payments are subject to their respective terms and conditions.
  • Management & Cancellation: You can manage your subscription and turn off auto-renewal by going to your Account Settings on the Apple App Store or Google Play Store after purchase. Your account will be charged for renewal within 24 hours prior to the end of the current period.
  • Automatic Renewal: Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period.
  • Tiers:
    • Free: Basic features with limited AI usage and no cloud storage.
    • Starter: Increased AI quotas and basic premium features.
    • Pro: Full access to all features, including Cloud Storage, Advanced Statistics, and maximum AI quotas.
  • Refunds: Refund requests must be directed to the respective app store (Apple or Google).

4. AI Features and Usage

The App includes AI-powered features such as Image Generation, Item Suggestions, and Auto-Pinning. Quotas for these features are reset monthly based on your subscription tier. We do not guarantee the accuracy or appropriateness of AI-generated content.

5. Intellectual Property

All content within the App (excluding user-uploaded images) is the property of Element.co. You retain ownership of images you upload, but grant us a license to host them for the purpose of providing the service (Cloud Sync).

6. Limitation of Liability

Mind Palace is provided "as is" without warranties of any kind. Element.co shall not be liable for any indirect, incidental, or consequential damages arising from your use of the App.

7. Governing Law

These Terms shall be governed and construed in accordance with the laws of South Africa, without regard to its conflict of law provisions.
